Shipping Terms for the European EnerPlus Online Shop
§ 1 Scope of Application
(1) These shipping terms apply to all orders placed by buyers via the European EnerPlus platform and to all products offered by sellers through the platform.
(2) The shipping terms regulate the modalities and costs of shipping, the availability of product collection, and special requirements for products with non-standard dimensions.
§ 2 Shipping Methods and Costs
(1) Shipping by the Seller
The seller is responsible for shipping the ordered products. Shipping costs must be clearly and transparently displayed in the shopping cart prior to purchase and may vary depending on weight, size, and delivery address. The seller and buyer are obligated to agree on shipping arrangements and costs in advance.
(2) Shipping Providers
The seller may organize shipment either through its own logistics arrangements or via third-party carriers. The choice of shipping provider rests with the seller, who remains responsible for compliance with delivery times and proper delivery.
(3) Oversized Products and Exceptions
Due to special dimensions of certain products (e.g., oversized or bulky items), shipping may not be possible via standard shipping services. In such cases, the seller will coordinate alternative shipping methods with the buyer to ensure proper delivery. The seller must inform the buyer in advance of any special shipping requirements.
§ 3 Collection of Products
(1) Collection Option
The seller may offer the buyer the option to collect ordered products directly from the seller or from a designated collection point. In this case, no shipping costs will apply. However, the seller may define additional conditions for collection (e.g., appointment scheduling).
(2) Collection Details
If collection is chosen, the seller must provide the buyer with the exact collection address, opening hours, and any specific collection procedures. The buyer is responsible for arranging a timely collection appointment where required.
§ 4 Delivery Times
(1) Estimated Delivery Times
Estimated delivery times are specified by the sellers within the product information. Delivery times may vary depending on the product and destination. Delivery periods commence upon shipment of the product, provided full payment has been received.
(2) Delivery Delays
In the event of shipping delays (e.g., caused by unforeseen circumstances or carrier-related issues), the seller will inform the buyer without undue delay and communicate an updated estimated delivery time.
§ 5 Seller Responsibilities
(1) The seller is responsible for proper packaging and secure shipment of the products. The seller is liable for loss or damage occurring during transport unless such loss or damage results from the buyer’s actions or force majeure.
(2) The seller is also responsible for accurate calculation and disclosure of shipping costs. Any additional costs arising from incorrect seller information (e.g., inaccurate weight estimates) shall be borne by the seller.
§ 6 Delivery and Acceptance
(1) The buyer must inspect the goods upon receipt. If products are damaged or incomplete, the buyer must notify the seller immediately to enable resolution (e.g., return or replacement).
(2) If the buyer refuses acceptance of delivery or is unavailable, the buyer shall bear the costs of re-delivery unless the failed delivery is attributable to the seller.
§ 7 Returns and Withdrawal
(1) Product returns are governed by the seller’s general return and withdrawal policies. Unless otherwise specified, the buyer bears return shipping costs except in cases of defective or incorrect products.
(2) For products with special dimensions or shipping requirements, the seller will inform the buyer of any specific return conditions and potential additional costs.
§ 8 Liability for Transport Damage
(1) The seller is liable for transport-related damage unless such damage results from buyer conduct or force majeure.
(2) The buyer must report transport damage as soon as reasonably possible after delivery to allow for compensation or remedy.
§ 9 Final Provisions
(1) European EnerPlus reserves the right to amend these shipping terms at any time. Updated terms shall apply to all orders placed after publication.
(2) The laws of the Federal Republic of Germany shall apply.
